I just talked to the dev. Here is her response 
 
"This is by design. We allow XML declaration in XML fragments because of the encoding attribute. Otherwise the encoding information would have to be transferred outside of the XML and manually set into XmlParserContext."

Hello, Dare, Miguel,

I am glad to see that you Microsoft guys are going to make possibly
incompatible changes in danger of incompatibility issues, and actually
I first saw that feedback page that is even publicly readable. It is
so cool and I'd like to be cool too unlike those days. Will use that
page for now.

BTW, I even didn't know there's such article on xml.com ;-)
