Atsushi, I got feedback on the bug report I filed against MS. As expected, they
claim their behavior is by design:

"The documentation for the constructor of XPathDocument(XmlReader) is slightly
incorrect in this case. We will take the appropriate steps to correct the
issue. The reader is advanced until the input depth of the reader goes out of
scope. This behaviour enables the XPathDocument to store XML fragments (more
than one root element) as well as regular XML documents."

Should our implementation be modified to match MS?
