 First of all this must be a Microsoft bug. They do pretty good job on
 documentation, so if it is not documented, it is very likely an
 unintended bug. You should first report Microsoft about their bug and

+They indicate they cannot make it for the whidbey release, but will make it the next version 
+of the .NET framework, which doesn't seem to have happened (there's no new System.Xml in 
+either 3.0 or 3.5)
