 heh, sadly, no - it is a duplicate (and should be resolved by design).

+Unfortunately some stupid user (me), reported bug #76115,
+which you fixed by using XmlNodeType.Element.
+So now xsl transforms outputting well-formed documents with xml
+declarations such as in my example fail. Should I open a new bug for that?
